Introduction

TDA is committed to protecting personal data of all persons with whom we interact. TDA has taken both technical and organizational measures to protect personal data the Company processes. We want to inform you of the processing activities the Company undertakes as it relates to your general use of the websites and systems the Company operates (collectively referred to as the “Site”), as well as your rights and obligations relating to your personal data. 

Who Processes Personal Data

TDA processes certain types of personal data from users of the Site. The Company may also contract with third parties to provide certain services on behalf of the Company. TDA takes steps to ensure that the third parties processing data on TDA’s behalf comply with data protection standards, including but not limited to, entering into contracts with the third parties, conducting security reviews of the third parties, and other similar efforts and processes.  

Consent

By using the Site, you hereby consent to the Company’s Privacy Policies. You also consent to the Company processing your personal data as it relates to the use of its Sites. You may revoke your consent at any time by ceasing to use the Site. If you do not wish to consent to the Company’s processing of your personal data and the Company’s privacy practices, you must not use this Site, or stop using this Site. 

Legitimate Business Interests

In addition to processing your data based on your consent, the Company also processes personal data on the basis of legitimate business interests. These legitimate business interests include ensuring the Site is secure and protected against threats of breach or compromise. In addition, TDA may process personal data respond to submissions and inquiries you make to TDA via its Site. Finally, TDA may also process usage data for purposes of maintaining and improving the Site. 

General Use

When using the Site for general information, the Company will not require that you provide information about yourself or your identity, except that TDA collects domain names, internet protocol (IP) addresses of visitors, location data, activity logs and cookies. We also collect the date and time and duration of each visit and the pages viewed. Domain names and IP addresses are not used to personally identify you. Instead, this information is aggregated to measure the number of visits, average time spent on the Site, pages viewed, and other similar usage information. 

Form Submissions 

There are portions of this Site where the Company may need to collect personal information from you for a specific purpose. One example is when you voluntarily submit your personal information in connection with a form submission. Providing this personal information enables TDA to respond to your requests. The information collected from you may include your name, address, telephone number, or e-mail address.  

Job Applicants

The Company may use the following additional information as it relates to applicants:  

  1. Consent. You consent to the Company processing your personal data as it relates to your application for employment. This means that you voluntarily consent to TDA processing any and all personal data you submit for consideration of employment. You also consent to having a TDA employee use this personal information to contact you to obtain additional information, perform interviews, and other application-related communications. By submitting your application, you also consent that TDA may review your application materials to determine your eligibility and qualifications as it relates to the position to which you have applied, as well as other positions within TDA for which you may be qualified upon explicit notice from a TDA representative. If you do not wish to be considered for other positions for which you may be qualified at TDA, inform the TDA representative when they contact you. 

  2. Legitimate Business Interests. TDA also processes personal data on the basis of additional legitimate business interests in the application process. This includes providing certain personal information to government entities as required by local laws, retaining certain personal information as required by local laws, and determining the eligibility of an applicant for a position to which the applicant has applied. 

Disclosure of Personal Data

  1. Internal Recipients. Certain departments within the Company receive and process personal data obtained from visitors to the Site on a “need to know” basis, particularly when their job is related to maintaining the Site, providing or updating content on the Site, or responding to inquiries made through the Site.  

  2. External Recipients. The Company may also transfer certain data to third parties who are contracted by TDA to perform certain Site-related administrative responsibilities. TDA does not share, sell, or lease personal data about you to third party processing for their marketing use.

It is also possible in very rare circumstances that your information may be shared in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or to another company. We may also share your information to a competent authority if we believe disclosure is in accordance with, or is otherwise required by, any applicable law, regulation, or legal process. This may include law enforcement officials, government authority, or other third parties as may be deemed necessary to comply with legal processes or meet national security requirements. Your information may also be shared in the event of litigation to defend the rights, property, or safety of the Company, its business partners, you, or others. Information may be shared when it has been aggregated, anonymized, and or de-identified so that it cannot reasonably be used to identify you. 

Children Under the Age of Thirteen 

The Children’s Online Privacy Protection Act (COPPA) imposes requirements on certain operators of commercial websites or online services. TDA is committed to protecting the privacy of children under the age of 13 and thus does not intend to solicit PII from children under the age of 13 without consent by their parent or guardian.  Users under the age of 13 and their parents or guardians are cautioned that the collection of PII volunteered online or by e-mail by children under the age of 13 without parental consent will be treated the same as information provided by an adult until TDA becomes aware that the user is under the age of 13.
